Hong Kong releases new AI data protection framework

The Office of the Privacy Commissioner for Personal Data (PCPD) in Hong Kong released the “Artificial Intelligence: Model Personal Data Protection Framework” (AI Framework) on June 11, 2024. The new framework provides practical recommendations for organizations adopting third-party AI systems to ensure compliance with the Personal Data (Privacy) Ordinance (PDPO). The AI Framework focuses on organizations procuring and implementing AI solutions from third parties, marking a shift from the PCPD’s 2021 guidance on the ethical development and use of artificial intelligence.

As the first comprehensive framework in the Asia-Pacific region addressing general AI procurement and implementation from a personal data privacy perspective, it represents a significant milestone in Hong Kong’s approach to regulating AI.

New AI data protection guidelines

The PCPD hopes the framework will facilitate Hong Kong’s development into an innovation and technology hub and bolster the expansion of the digital economy in the Greater Bay Area.

Dr. Isabella Liu, who advises clients on IP rights and plays a significant role in patent prosecution in China and Hong Kong, described the new framework as a pivotal development. Dominic Edmondson, an expert in information technology advisory, IT sourcing, cybersecurity, and global data privacy, highlighted the framework’s potential impact on businesses in the Greater China region.

The introduction of the AI Framework is expected to enhance Hong Kong’s role as a leader in technological innovation while safeguarding personal data privacy standards.
