The Detroit City Council has unanimously approved an amendment to a controversial law in reaction to a fatal incident at a local gas station last year. The revised law prohibits businesses from using locking systems that prevent customers from leaving their premises at will, offering a safer shopping experience for customers, especially in times of crisis.

This alteration in the law pays tribute to Gregory Karlos Samuel Fortner-Kelly, a local resident who tragically lost his life in a shooting incident at a Detroit Mobil Gas Station due to an internal locking system. This event pushed city officials into revising laws and restrictions about carrying firearms, especially around gas stations.

The new policy is now known as the Fortner-Kelly Act, reflecting the legacy of Fortner-Kelly while emphasizing Detroit’s dedication to public safety. This act has been highly appreciated by local residents, who are hopeful to see more safety reforms in the future.

The unfortunate event unfolded when store clerk Al-Hassan Aiyash locked Samuel McCray inside after his card was declined.

Detroit law amendment after fatal incident

McCray responded by shooting inside the gas station, which resulted in injuries to three individuals and ultimately claimed Fortner-Kelly’s life.

Currently, McCray is facing several charges, including first-degree murder, in the upcoming court hearing on July 8. Aiyash, too, is facing legal consequences for his decision to activate the door lock, questioning if he knew McCray was armed before locking the doors. Both cases are presently under review by the Court of Appeals and the Supreme Court.

Accordingly, the updated law makes it illegal to use door locks to knowingly trap a customer in venues with a bulletproof shield separating the operator from the consumers. Infractions of this law can lead to a misdemeanor charge.

Councilman James Tate, voicing his commitment to improved safety measures, has expressed that the purpose of this amendment is to minimize potential threats in commercial spaces like gas stations, convenience stores, and liquor stores. He acknowledges the challenges ahead but remains steadfast in his fight against store owners detaining suspected thieves.
